Kentucky Lawmakers Consider Proposal to Allow Medical Marijuana Use in Hospitals

Kentucky lawmakers are considering a proposal that could make medical marijuana more accessible for patients receiving end-of-life care. While Kentucky's medical marijuana program is already underway, current laws and hospital policies can prevent qualified patients from continuing to use their medication after being admitted to a hospital or hospice facility.
The proposal, which was recently discussed during an interim legislative committee meeting, would allow terminally ill patients to continue using legally obtained medical marijuana while receiving inpatient care. Although the proposal has not yet been introduced as legislation, lawmakers from both parties indicated they are interested in exploring the issue further.
For patients who rely on Kentucky medical marijuana to manage pain and other symptoms, this could represent an important step toward improving access and quality of life.
Why Are Lawmakers Considering This Change?
Kentucky legalized its medical marijuana program in 2023, with the law taking effect on January 1, 2025, allowing qualified patients with certain medical conditions to legally access medical marijuana with a physician’s certification. The program’s licensing and regulatory process began in 2024, preparing the state for patient access once the program became operational. Kentucky’s medical marijuana dispensaries are now open statewide, providing registered patients with access to a variety of products, including flower, edibles, vapes, and other approved medical marijuana products.
Hospitals often receive federal funding through Medicare and Medicaid and must comply with numerous federal regulations, making many facilities hesitant to allow medical marijuana use, even when it is legal under state law. As a result, patients who legally use Kentucky medical marijuana at home may be required to stop using it once they are admitted to a hospital or hospice facility.
Lawmakers say this creates unnecessary hardship for terminally ill patients who depend on medical cannabis to help manage symptoms during some of the most difficult moments of their lives.
What Would the Proposal Do?
The proposal being discussed is relatively narrow in scope. Rather than expanding Kentucky's medical marijuana program broadly, it focuses specifically on compassionate care for terminally ill patients.
If ultimately approved, the legislation could:
Allow terminally ill patients to continue using legally obtained medical marijuana while in hospitals or hospice facilities.
Establish guidelines for healthcare facilities that choose to permit medical marijuana use.

While the exact rules vary by state, these policies generally recognize that terminally ill patients should not automatically lose access to physician-recommended treatment simply because they enter a healthcare facility. Some states have already taken steps to address this issue. For example, Virginia and Louisiana allow patients with an active marijuana card in hospice care to continue accessing medical marijuana under the state’s program. Kentucky lawmakers appear to be studying similar approaches as they evaluate whether changes should be made to the state's program.

On June 2nd, 2026, Governor Beshear announced an executive action that provides additional clarity regarding qualifying medical conditions under the state's medical marijuana program.
