Kentucky patients who have been purchasing medical marijuana from other states under Governor Andy Beshear's Executive Order should be aware of an important deadline. The Executive Order that provided legal protections for qualified patients obtaining medical marijuana outside of Kentucky is set to expire on July 1, 2026.

With Kentucky's medical marijuana program now fully operational, state officials are encouraging patients to transition into Kentucky's official program before the deadline arrives.

Why the Executive Order Is Ending

In 2023, Governor Beshear signed an Executive Order that provided a conditional pardon for Kentuckians who purchased medical marijuana legally in another state. At the time, Kentucky's medical marijuana program had not yet launched, and patients did not have access to licensed dispensaries within the state. The Executive Order provided protections for qualifying patients who legally purchased medical marijuana from other states while Kentucky worked to implement its own program.

Today, the situation is different. Kentucky now has licensed marijuana practitioners, approved patients, and dispensaries operating throughout the state. Because patients can now legally obtain medical marijuana within Kentucky, the state is ending the temporary protections that were provided through the Executive Order.

What Happens After July 1?

Beginning July 1, 2026, the legal protections provided under the Executive Order will no longer apply.

Patients who continue relying on medical marijuana purchased from another state could lose the safe-harbor protections that previously covered possession and transportation under the Executive Order.

Governor Beshear has urged patients to take action before the deadline to ensure they maintain uninterrupted legal access to medical marijuana.

How to Access Medical Marijuana Legally in Kentucky

If you have been using out-of-state medical marijuana, now is the time to join Kentucky's medical marijuana program.

The process is straightforward:

Step 1: Schedule an Appointment With a Kentucky Marijuana Practitioner

Patients must first meet with a registered Kentucky marijuana practitioner for a medical marijuana evaluation.

During the appointment, the practitioner will review your medical history, symptoms, and treatment goals to determine whether medical marijuana may be appropriate for your condition.

Recently, Governor Beshear signed an Executive Order providing clarification on qualifying conditions, indicating that patients with the following medical conditions can qualify for marijuana use in Kentucky:

The recent clarification of qualifying conditions is helpful for patients to complete their transition into Kentucky's medical marijuana program before the Executive Order expires.

Step 2: Obtain Your Kentucky Medical Marijuana Card

After your appointment with the marijuana practitioner, if approved, you can complete your registration with the state and receive your Kentucky medical marijuana card.

The state review process can take up to 30 days, so patients should begin the appointment process as soon as possible to avoid potential interruptions in access. At Kentucky Marijuana Card, we help patients complete and submit their state application during their appointment, so everything is taken care of before they leave. Once the state approves the application, patients receive their Kentucky medical marijuana card directly from the state via email and can begin purchasing medical marijuana from licensed Kentucky dispensaries.

Step 3: Visit a Kentucky Dispensary

Once approved, patients can purchase medical marijuana products from licensed Kentucky dispensaries.

Kentucky dispensaries currently offer a variety of products, including:

Once the state approves the application, patients will receive an email notifying them of their approval. They can then log back into the same state portal used to submit their application to access their Kentucky medical marijuana card. When visiting a dispensary, patients should be prepared to show their active medical marijuana card along with a valid government-issued photo ID.

Why Patients Should Act Now

As the July 1 deadline approaches, Kentucky is expected to see a significant increase in medical marijuana appointments and state registration applications.

Patients who wait until the last minute may face longer appointment wait times and potential delays in the state processing their registration.

Scheduling an appointment now can help ensure a smooth transition into Kentucky's medical marijuana program before the Executive Order expires.

Final Thoughts

The expiration of Kentucky's out-of-state medical marijuana Executive Order marks an important milestone for the state's medical marijuana program. While the temporary protections are ending, patients now have a legal pathway to obtain medical marijuana directly within Kentucky.

If you have been relying on medical marijuana from another state, now is the time to schedule an evaluation with a Kentucky marijuana practitioner, complete your state registration, and prepare for the July 1 transition. Taking action today can help ensure continued legal access to the medical marijuana products you depend on.
