Marijuana and Insurance Coverage: Does Medicare or Medicaid Cover Your Medicine?

Right now, the answer is no, but there are some important updates and future possibilities to understand.


Does Insurance Cover Marijuana?

Right now, Medicare and Medicaid do not cover marijuana. Patients have to pay out of pocket for their medical marijuana evaluation, state fee, and product from licensed dispensaries.


This is mainly because marijuana is still treated as a federally restricted substance. Insurance programs like Medicare, Medicaid, and private insurance companies follow federal guidelines, which means they do not currently recognize marijuana as a covered medication. Even private insurers typically base their coverage decisions on federal law and FDA approval, so they generally do not include marijuana in their plans.


Why Isn’t Marijuana Covered?

There are a few key reasons why marijuana isn’t covered by insurance:


1. Federal Restrictions

Even though certain states like Kentucky allow medical marijuana, it is still not legal at the federal level. Because of this, insurance providers cannot treat marijuana like a standard prescription medication and can not cover it.


2. Not FDA-Approved

Marijuana products available at dispensaries have not gone through the FDA approval process and are not classified as approved medications by the FDA. Insurance companies typically only cover medications that meet strict federal approval standards.


3. Unique Status as a Medical Treatment

Unlike traditional prescriptions, marijuana is recommended by a licensed marijuana healthcare provider rather than formally prescribed. This difference also impacts insurance coverage.


New Developments to Watch

There are ongoing efforts at the federal level to reconsider how marijuana is classified and how it can be used in healthcare. One of the biggest developments is the proposed federal rescheduling of marijuana, which would move it from a more restrictive category to a less restrictive one. This change would recognize its medical use and make it easier to study and regulate.


If marijuana is officially rescheduled, it could open the door for major changes in healthcare. For example, researchers would have fewer barriers to conducting clinical trials, and marijuana-based treatments could move closer to meeting FDA approval standards. Over time, this could allow certain marijuana products to be treated more like traditional medications.


If that happens, insurance companies may eventually begin to cover some marijuana-based treatments. However, this would not happen overnight. Products would still need to go through the FDA approval process, and insurance providers would need to update their policies. While rescheduling is a significant step forward, widespread insurance coverage would likely take additional time to fully develop.


Some proposals and pilot programs are also exploring ways to include hemp-derived products in insurance or healthcare coverage.

  • A federal pilot program is being discussed that may allow certain Medicare patients to receive limited financial support for hemp-derived products, such as CBD

  • In some cases, patients could receive up to a set amount annually for these types of products

  • These programs are not in place yet and do not apply to full marijuana products with higher THC levels


This means that while there is movement toward expanding coverage, traditional marijuana products are still not included.


What This Means for Kentucky Patients

For patients in Kentucky, it’s important to understand the marijuana laws:
