There has been growing interest in whether the federal government will move marijuana from a Schedule I to a Schedule III drug. This topic is important to many Kentuckians, especially now that the state’s medical marijuana program has launched and patients are getting certified before dispensaries open.

What Does Rescheduling Mean?

Marijuana is currently listed as Schedule I under federal law, a category used for substances considered to have no accepted medical use and a high potential for misuse.

A move to Schedule III would show that the federal government recognizes marijuana’s medical value. Schedule III substances remain controlled, yet they are viewed as safer and more medically useful than Schedule I substances.

This change would not make marijuana federally legal, so state programs, including Kentucky’s, would continue operating under their own rules.

What’s Happening at the Federal Level?

The federal government is reviewing whether marijuana should move to Schedule III. A recommendation by the Department of Health and Human Services (HHS) supporting rescheduling has been made, and the DEA is now working through the required steps for evaluating that recommendation.

The process includes reviewing public comments and completing several regulatory stages. A final decision on rescheduling has not been made, and no official timeline has been announced.

What Would Schedule III Mean?

  • The federal government would formally recognize marijuana’s medical use.

  • Research could become easier due to fewer restrictions on Schedule III substances.

  • Legal marijuana businesses could face fewer challenges when federal rules are changed. Many state-licensed businesses struggle with banking, taxes, and federal restrictions because marijuana is still listed as a Schedule I substance. A move to Schedule III could ease some of this pressure by making it easier for businesses to work with financial institutions, fall within federal guidelines, and manage day-to-day operations without facing the same level of risk or uncertainty.

Things That Stay the Same:

  • Marijuana would remain federally controlled, meaning it wouldn’t be legal for use nationwide.

  • State marijuana programs would continue to operate under state law.

  • Federal oversight and rules would still apply, even under a different schedule.

What This Means for Kentucky Patients

Kentucky patients can now be certified for medical marijuana, and dispensaries are expected to open before the end of 2025. Rescheduling at the federal level would not change the state’s rollout or the rules already in place.

A move to Schedule III could help support the medical value of marijuana, which may reduce stigma and encourage further research. The shift could also lead to a clearer path for scientific studies that help doctors and patients better understand how marijuana works for specific conditions.

Rescheduling would not immediately expand access, alter Kentucky laws, or create recreational availability; however, it may have an impact on people’s perception of marijuana.

What to Watch Going Forward

Kentuckians should stay updated on:

  • Official announcements from the federal government

  • Kentucky’s progress as dispensaries prepare to open

  • New research or policy developments related to medical marijuana

The federal process may take time, yet Kentucky’s medical program is moving ahead. Patients can get their marijuana card now while the state prepares to open dispensaries. Patients with a valid marijuana card will be able to visit dispensaries on day one!
