Will Cannabis Be Legalized in Kentucky in 2023?


Medical marijuana is legal in 37 states and recreational marijuana is legal in 21 states. Many Kentucky residents are beginning to grow weary waiting for the relief they deserve and may be wondering when the Blue Grass state will pass legislation to launch a medical cannabis program.

What Progress Has Been Made?

In April of 2022, Governor Andy Beshear created the Team Kentucky Medical Cannabis Advisory Committee and announced its members in June. The committee has toured Kentucky and listened to residents’ opinions on the matter.


Many of the stories the committee heard were quite moving, from mothers whose kids would greatly benefit from medical marijuana, to veterans or trauma survivors. After the committee released a report on their findings, the Governor signed two executive orders.


One executive order has allowed Kentuckians to purchase medical marijuana if they are suffering from any of the approved medical conditions. The second order was meant to regulate delta 8 THC products.


What’s the Hold Up?

Even with the data collected from the committee, republican members of the legislature want to see more research on cannabis. They fear that the legalization of medical marijuana will lead to the legalization of recreational marijuana, which they would not support.


However, the governor has also stated that he would not support the legalization of recreational marijuana, and has not expressed support for the allowance of home cultivation for medicinal purposes.


There will no doubt be a bill to legalize medical marijuana sometime this 2023 session, so we hope that the lawmakers will come to their senses and realize that the health of Kentucky residents is not a political issue.
