No Delay to the Launch of Kentucky’s Marijuana Market Despite a Licensing Audit

Despite growing scrutiny over how marijuana licenses were awarded in Kentucky, state officials have confirmed that Kentucky’s medical marijuana program remains on track with no delays to its launch. The program has been live since January, and patients are currently being seen at clinics to begin the certification process for their medical marijuana cards.

State Auditor Allison Ball recently launched an investigation into how medical marijuana licenses were awarded across Kentucky. At the heart of the audit are concerns about fairness, favoritism toward out-of-state companies, and a potential lack of opportunity for Kentucky-based cultivators, processors, and dispensaries.


Ball’s team is probing several issues, including:

  • “App-stacking”: when companies create multiple LLCs to flood the license lottery with applications, increasing their chances of being selected.

  • Vertical integration: where one company holds cultivation, processing, and dispensary licenses, possibly shutting out smaller, local operators.

  • Limited representation: with few, if any, licenses awarded to actual Kentucky farmers.


One company under scrutiny is Arkansas-based Dark Horse Cannabis, which allegedly created 350 LLCs and successfully secured multiple types of licenses across the supply chain. This raised red flags about transparency and fairness, especially for local entrepreneurs trying to break into the industry.


Program Integrity Under Review

Despite these concerns, Ball has been clear that the licensing audit will not affect the timeline of the medical marijuana rollout. She emphasized that her office’s goal is to ensure fairness, not to delay or suspend the program.


“My goal is not to slow anything down, and I don’t see any reason why anything should be slowed down,” Ball stated.


Lieutenant Governor Jacqueline Coleman echoed this sentiment, reinforcing that the administration’s work has been “above board” and remains committed to expanding access to medical marijuana in a timely and transparent manner.


Kentucky’s Medical Marijuana Program
