Kentucky Medical Marijuana Cultivators

What is a Marijuana Cultivator?

A cultivator license authorizes its holder to grow medical marijuana in an enclosed, locked facility and sell medical marijuana to a licensed medical marijuana processor, producer, or dispensary in Kentucky. Cultivators grow and harvest the marijuana plants used to make safe, accessible medical marijuana products in Kentucky.

What Do the Different Tiers Mean?

In Kentucky's medical marijuana program, cultivator licenses are divided into four tiers, primarily based on the size of the cultivation area allowed.

Tier I:

  • Smallest cultivation area: Limited to a maximum of 2,500 square feet

  • Ideal for: Small-scale growers or startups

​

Tier II:

  • Medium-sized cultivation area: Allowed up to 10,000 square feet

  • Ideal for: Mid-sized cultivation operations

​

Tier III:

  • Larger cultivation area: Can grow up to 25,000 square feet

  • Ideal for: Larger cultivation businesses

 

Tier IV:

  • Largest cultivation area: Permitted to cultivate up to 50,000 square feet

  • Ideal for: Large-scale or industrial cultivation operations

Key Differences Based on Their Tier

Cultivation Area: The primary distinction between the tiers is the maximum allowed cultivation area, which increases with each tier.

 

Application and Licensing Fees: Generally, higher tiers have higher application and licensing fees due to the increased scale of operation.

 

Operational Scale: Each tier is suitable for different scales of operation, from small startups to large, industrial-scale businesses.

In essence, the tier system in Kentucky's medical marijuana cultivation licenses allows businesses to choose the scale of their operation based on their resources and business plan.

Who Has Been Awarded Cultivation Licenses?

Medical marijuana businesses in Kentucky were awarded licenses to begin business ventures after a lottery was held in 2024. Twenty-six applicants were selected for medical cannabis cultivation and processor licenses. Here is the full list of companies who have received licenses as of early May, 2025. Keep in mind that this list may change as time goes on:

(CW Bluegrass, LLC, original licensee, requested approved to sell or transfer their license to Flower Power 5390, LLC, per KRS 218B.080(6) and 915 KAR 1:020, Section 10. OMC approved this request on​ April 11, 2025 and the license transfer was completed on May 20, 2025.)

  • L&O Legacies (Jessamine Co.) (Initially licensed in Boyd Co. OMC approved request for change of location to Jessamine Co. on December 19, 2024. OMC approved an additional change of location within Jessamine Co. on March 27, 2025.)

  • Slaughter Branch LLC (Hopkins Co.) (Initially licensed in Hopkins Co. OMC approved request for change of location within Hopkins Co. on December 19, 2024.)

  • KY Cultivation, LLC (Bullitt Co.) (Elevated Essence LLC, original licensee, requested approval to sell or transfer their license to KY Cultivation, LLC, per KRS 218B.080(6) and 915 KAR 1:020, Section 10. OMC approved this request on February 20, 2025 and the license transfer was completed on March 5, 2025.)

  • Wong Investments LLC (Fayette Co.) (Initially licensed in Christian Co. OMC approved request of location to Fayette Co. on March 24, 2025.)
